INTRODUCTION

As of June 2007, the European Regulation 1907/2006 concerning the Registration, Evaluation, Authorization of Chemical Handling (REACH) came into force.

The objective of the legislation is to protect human health and the environment from risks arising from the use of certain chemicals.

It has taken 7 years of discussion before this legislation was approved by the European Parliament and it affects manufacturing and import of substances placed on the European market, either in their pure state or in preparations or contained in articles. Similar legislation is now being introduced other markets.

Two of the main obligations under REACH are:

  • Registration of all chemical substances put on the EU markets in quantities greater than 1 Tonnes per annum.
  • Identification of certain Substances of Very High Concern (SVHCs) present in articles sold on in EU markets.

REGISTRATION OBLIGATION

All Chemical substances manufactured or imported into the EU in quantities of 1 tonne or more per year must be registered with the ECHA. Substances already on the EU market had to be pre-registered before 1/12/2008 in order to stay on the European market after that date.

CARL KAMMERLING INTERNATIONAL LTD ACTIONS

Carl Kammerling International Ltd is aware of its responsibilities under the REACH legislation.

  • As an importer of articles, we have reviewed all our product ranges and conclude that as we do not manufacture chemicals within the EU or uniquely import such into the EU in quantities exceeding a tonne per year, we can therefore confirm that we have no registration obligations ourselves.
  • As a down stream user, Carl Kammerling International Ltd has been in close contact with our suppliers to confirm that they, or their sub-suppliers, have registered any substances within scope, under their own obligation.

Now that the pre-registration period has ended, Carl Kammerling International Ltd can confirm that we do not expect any disruption in our supply chain due to the registration obligation for ourselves or our suppliers.

OBLIGATION TO IDENTIFY AND DECLARE SUBSTANCES OF VERY HIGH CONCERN (SVHC)

Today there are currently 73 SVHC’s identified on the current ECHA ‘Candidate list’ of 19th December 2011 – see the link below for full details. (http://echa.europa.eu/chem_data/candidate_list_table_en.asp). It is likely that more substances will be added to the list in the future.

CARL KAMMERLING INTERNATIONAL LTD ACTIONS

Under REACH we recognise an obligation to inform customers on the presence of any SVHC content >0.1% w/w in the products we offer. Carl Kammerling International Ltd has concluded our review of the material content in our products and can declare to our customers, for the SVHC status for all our products [click here[REACH SVHC.xls]

As more SVHC’s are added to the ‘Candidate list’, Carl Kammerling International Ltd will maintain the information available to our customers regarding the presence of these new SVHCs if they exist in our products.

If substance restrictions are announced, Carl Kammerling International Ltd will comply by modifying the products specification and discontinuing non compliant products.

Carl Kammerling International Ltd REACH coordination is carried out by our Quality and Environmental Manager, who has been in close contact with the suppliers to obtain the requested SVHC information and is also organising feedback for the customer information requests we receive.

SVHC CERTIFICATES

A certificate confirming the non-use of Substances of Very High Concern under REACH 1907/2006/EC is available for all products which are SCHC free.

Safe Use / Handling Instruction are available if a SVHC is present in any of our products.

MATERIAL SAFETY DATA SHEETS

Material Safety data Sheet (MSDS) are available for all for materials containing SVHC’s
